Suit Against La Marque City Councilman Dismissed

DISMISSED FOR WANT OF PROSECUTION. (Whatever that means)

Civil Case #202107817 TOMCZAK, MARTIN vs. SIX BROTHERS CONCRETE PUMPING LLC was filed in 2021 in Harris County and was scheduled for trial on November 10. On November 8 the case was dismissed. I assume this means it was settled prior to trial and maybe for good reasons. Six Brothers Concrete Pumping is owned by La Marque City Councilman Joseph Lowry.

The case concerns a non compete clause signed by Martin Tomczak. According to the court documents Martin claims Lowry threatened him and potential employers with lawsuits based upon this non compete document leaving Tomczak unemployed. One of the documents submitted to the court is a list of texts and correspondence from Lowry. You can read the entire 27 pages here. Here is just one of the texts:

This is so classic Lowry. He must have a lot of money to pay for all these lawsuits but he still doesn’t have enough to pay his damn taxes. He has another trial scheduled for Jan 26 in Galveston County. Film at 11.
