Lawsuit Against La Marque Council Member Delayed. Again.

It’s Lowry. Again.

La Marque City Councilman Joseph Lowry is being sued by a number of individuals as well as “all residents of Galveston County, Texas.” That is interesting. Case # 24-CV-2218 | Walter Burt, Et Al vs. Joseph Lowry trial date was set for 1/26/26 but has now been delayed till 5/18/26.

The Judge has issued the jury preliminary instructions. It is a very interesting read. You can read the entire instructions here. This looks like a summary paragraph:

“The plaintiffs allege that defendant has been posting harassing, defamatory, threatening and stalking statements on Facebook. The plaintiffs claim these posts have affected their daily lives and businesses. The defendant operates a news page, personal page, and numerous other pages on Facebook under various names where he posts statements about the plaintiffs.”

According to the instructions there are six counts the jury must make a decision on. Count six, Breach of Contract against Kimberley Yancy is interesting. Back in 2022 Lowry was sued for harassment by Council Member Yancy resulting in an agreement to refrain from threatening or harassing comments that would give rise to criminal action on social media, newspapers, and any media outlet not explicitly stated herein. Galveston County Case # 22-CV-0993 I bet count six is referring to Lowry’s breach of this agreement. The counts are:

  1. Defamation
  2. Harrassment
  3. Stalking
  4. Intentional Infliction of Emotional Distress: 
  5. Public Disclosure of Private Facts: 
  6. Breach of Contract against Kimberley Yancy 

So breakfast tacos will be delayed till May.
