DISMISSED FOR WANT OF PROSECUTION. (Whatever that means)

Civil Case #202107817 TOMCZAK, MARTIN vs. SIX BROTHERS CONCRETE PUMPING LLC was filed in 2021 in Harris County and was scheduled for trial on November 10. On November 8 the case was dismissed. I assume this means it was settled prior to trial and maybe for good reasons. Six Brothers Concrete Pumping is owned by La Marque City Councilman Joseph Lowry.

The case concerns a non compete clause signed by Martin Tomczak. According to the court documents Martin claims Lowry threatened him and potential employers with lawsuits based upon this non compete document leaving Tomczak unemployed. One of the documents submitted to the court is a list of texts and correspondence from Lowry. You can read the entire 27 pages here. Here is just one of the texts:

This is so classic Lowry. He must have a lot of money to pay for all these lawsuits but he still doesn’t have enough to pay his damn taxes. He has another trial scheduled for Jan 26 in Galveston County. Film at 11.

You just can’t make this stuff up.

La Marque City Councilman Joseph Lowry (again) wants special treatment from the interim City Manager. It’s about as petty as some of the articles I write about elected officials in the Bay Area. In order to save money and city resources the City made the decision to distribute the agenda for the upcoming city council meeting electronically. Prior to this the agenda was printed and hand delivered to council members. Using email or posting the agenda online is what everyone does in this day and age of 2025. The agenda is also public record posted on the La Marque website.

But according to Lowry “I dunt no how to use an ee-lectric cumpooter”, which he didn’t actually say but implied it in his pathetic video he posted to Facebook. He claims he is not a “science computer” but he does have enough skills to post AI generated articles on his Lousy News Network. He has enough skills to create a Facebook page, post on a daily basis, create and post harassing videos, and bitch and moan about rampant corruption which doesn’t exist.

But he doesn’t have enough science computer skills to click on a link and print an agenda like everyone else including the public. It isn’t hard to do. Read your email. Click on the attachment. Apple-P to print. Maybe Lowry can’t afford paper to print the 2 page agendas. Or maybe he doesn’t have enough money for a printer or to pay the $43,000 in back taxes. Or maybe he is dumber than a sock full of rocks.

So watch as he wastes more money and drags the City into court like he did back in 2024 and lost miserably. Lazy bastard.

You have to wonder what caused the outrageous number of Open Record Requests in 2025.

It’s Lowry. Again. Council Member Joseph Lowry was elected in May of 2024 and all hell has broken loose including using and abusing the Freedom of Information Act (FOIA) or Public Information Requests (PIRs). In 2024 150 PIRs were opened. In 2025 465 were opened.

According to records provided by La Marque 150 open records requests were filed in 2024. 61 of them were filed in the last qtr. 105 were closed as “fulfilled”. 36 resulted in “no records” available. The other 9 requests were listed as “not a request” or others.

In 2025 465 PIRs were opened. 229 were closed as “fulfilled”. 141 were closed as “No records”. 25 were closed as “Not a request” or “Request Withdrawn”. 5 were closed as “Denied. Investigative Records”.

Lowry opened 24. His wife opened 11. Lousy News Network opened 2. Many were opened concerning Lowry including requesting Lowry’s proof of bribes, the details of his terrorist threat report to the La Marque Police Department, and information about his $50,000 COVID grant.

La Marque City Council Members were provided a copy of a demand for an investigation into CM Joseph Lowry concerning his history of harassment, official misconduct, and his possible illegal occupancy of his seat on Council. If you have kept up with Lowry’s many escapades you’re probably wondering why action has not been taken already. Maybe this demand will result in a serious investigation and finally clear the air. Here is the demand in a nutshell:

• Action is requested in 5 days
• Investigate whether Lowry is legally on Council, remove if he is not
• Investigate his numerous acts of harassment
• Investigate his harassment at citizens work place
• Investigate official misconduct
• Investigate stalking allegations
• Investigate civil rights violations

Action Required Regarding Councilman Joseph Lowry’s Illegal Occupancy, Harassment, and Official Misconduct – 5-Day Deadline

Dear, Mayor, Council, City Manager, City Attorney, District Attorney, and Chief of Police

This serves as a Formal Legal Notice that as a concerned citizen of La Marque I demand immediate, decisive action regarding the continued presence and misconduct of Councilman Joseph Lowry.

Our community has conclusive evidence and documented testimony that requires your immediate legal and administrative intervention.

I. THE LEGAL BASIS FOR IMMEDIATE REMOVAL (5-DAY DEADLINE)

The citizens s well as I have verified information that Councilman Joseph Lowry is ineligible to hold public office due to a final felony conviction, a direct violation of the Texas Election Code \S 141.001(a)(4).

His continued service constitutes an ongoing fraud upon the City and a violation of state law.

DEMAND 1 (To the City Attorney & District Attorney):

I formally demand that the City Attorney and/or the District Attorney immediately prepare and file a request for a Writ of Quo Warranto proceeding, as authorized by the Texas Civil Practice and Remedies Code, Chapter 66, \S 66.001, to judicially determine and enforce Councilman Lowry’s removal from office.

II. DOCUMENTED MISCONDUCT, HARASSMENT, AND CIVIL LIABILITY

The citizens and i have all compiled an extensive log of incidents demonstrating a pattern of egregious official misconduct, including:

• Harassment and Stalking: Utilizing his position to engage in physical following, sending strange, unsolicited packages, and making anonymous harassing calls to citizens’ private residences (Texas Penal Code \S 42.07 and \S 42.072).

• Economic Interference: Maliciously and anonymously contacting citizens’ places of employment, resulting in job suspensions, firings, and loss of livelihood.

• Civil Rights Violations: Using discriminatory and defamatory language against Black citizens, referring to them as “thugs and gangsters,” demonstrating a violation of public trust and creating a hostile environment.

DEMAND 2 (To the Mayor, City Manager, & Chief of Police):

I formally demand that the Mayor, City Manager, and Chief of Police immediately launch a comprehensive investigation into the documented criminal and ethical complaints, including the misuse of office to interfere with employment, and provide full cooperation with victims pursuing charges of stalking and harassment and all other charges as well.

III. THE DEADLINE FOR ACTION

We are committed to peace, discipline, and structure, and we expect the City to uphold the law.

You are hereby given five (5) calendar days from the date of this notice (October 28, 2025) to provide a written response and a concrete plan of action outlining how your respective offices will comply with these demands.

Failure to act by Monday, November 3, 2025 will be interpreted by the community and my legal counsel as a deliberate decision of complicity and calculated indifference, leaving me no recourse but to immediately proceed with the filing of a broad-based Civil Lawsuit against Councilman Lowry and the City of La Marque.

I expect and demand accountability. Now and not later

It’s Lowry. Again.

Joseph Lowry might be in a pickle. Ever since becoming politically active in La Marque he has been nothing but a pain in the ass for the city. I am sure many would love to see him resign from Council ending a period of embarrassment for the city. Resigning to stop any further digging into his past is the easy thing to do but do not count on it. Unfortunately another document filed with the King County Court might add fuel to the firing of Lowry.

Quick Background:
When Lowry applied to run for City Council in 2024 he checked the box “I have not been finally convicted of a felony.” That isn’t exactly true. He pled guilty to two separate felonies concerning the possession of meth in Washington State. He should have checked the box  “I have been finally convicted of a felony, but I have been pardoned or otherwise released from the resulting disabilities of that felony conviction and I have provided proof of this fact with the submission of this application” and then provided the proof. If he had checked the second one he would have had to provide a copy of the proof, but according to the following document he couldn’t.

New Damning Evidence:
This new document, “STATE’S MOTION AND ORDER VACATING AND DISMISSING JUDGMENT AND SENTENCE FOR POSSESSION-ONLY OFFENSE(S) PURSUANT TO STATE V. BLAKE” was filed with King County Washington CASE #: 99-1-08852-9 KNT but it was filed in May of 2025, a full year AFTER he was elected. What I do not understand, because I am not an undercover investigation reporter or an attorney, is why this is not signed? Why was it posted in early May of 2025? Maybe it is because the question about his eligibility was called into question at an April 28, 2025 meeting. You can watch the meeting here starting at 2:21:38.

Past Evidence:
Now realized in 2021 he had a document posted to his case titled “ORDER VACATING THE JUDGEMENT UNDER CrR 7.8 AND DISMISSING THE CASE PURSUANT TO STATE V. BLAKE”. This one is signed and was filed 3 years prior to Lowry’s election.

In Conclusion:
So what does all this mean? That is a good question and I’m just asking questions. I am going to speculate here. This unsigned document is a motion to vacate and dismiss his case which will be signed at a later date. Once signed it will be posted. I wonder if Lowry, after the April 28th meeting, realized his “vacation” wasn’t actually finalized and then petitioned King County to do so.

As I said, this will probably end up in court.

The undercover investigative journalist and La Marque City Councilman, Joseph Lowry, claims he is going to file a harassment complaint against an individual. Like every other empty threat Lowry has made, I doubt seriously if he files his nails much less a harassment complaint. It’s as if his harasser confronted him in a bathroom at Roadhouse, harassed him at his tabled while he was chowing down on a pork chop with his family, and then waiting for him in the parking lot to continue the harassment. In a long winded, AI generated, post on his Lousy News Network, Lowry claims:

A disturbing incident unfolded this week when Councilman Joseph Lowry — administrator of the Talk of La Marque Uncensored community forum — began receiving a series of harassing text messages from an unknown phone number.

DISTURBING! Oh for the love of all that is holy! DISTURBING I tell you! For the love of pearl, one can only imagine what horrors were bestowed upon sweet Joe. I am sure it will all come out once he drafts up his felony warrant and reports to the La Marque Police Department and the FBI, CIA, NSA, as he claimed he was doing to others in the community. BTW He didn’t. He can’t. Warrants are drafted by law enforcement. Only. Period.

Lowry is full of shit. He talks a great game. He threatens people with lawsuits, arrest, and charges of harassment yet like a bad golfer, doesn’t follow through. Lowry on the other hand has numerous civil suits filed against him and he has been convicted for a number of felonies concerning the possession of Meth.

So like everyone else, we are waiting for his frivolous complaint to be filed. Film at 11. Literally.

What kind of grown ass man would post something like this? To call this childish would be an absolute insult to children. This is from La Marque City Councilman Joseph Lowry. It’s as if he is begging someone to come slap the living shit out of him so he can video it and then play the victim card. Again. This is absolutely disgusting and coming from a mentally challenged individual.

Based upon the recent letter provided by the Texas Attorney General and Lowry’s application to run for office Lowry should consider stepping down from his high horse.

The summary from the AG is interesting and possibly damning. Unlike Lowry I am not an undercover investigative journalist or have a Jewish Prudence degree so I can’t really state what the living hell this letter means to his application, his running, or his seat. Here it is:

Now as stated in the above posts his convictions were vacated 16 years later after a Washington Supreme Court ruling in Blake v. State. If that is the case, then he should have checked the box “I have been finally convicted of a felony, but I have been pardoned or otherwise released from the resulting disabilities of that felony conviction and I have provided proof of this fact with the submission of this application”

Falsifying a government document is serious. Ask Hunter Biden. Lucky for Lowry and Galveston County Jimmy Fullen, their names are not Hunter Biden.
